Terms of Use

These terms are the agreement between you and BikeViewer for use of the BikeViewer website and application. Please read them, particularly section 8, which explains the limits of what a fit simulation can tell you.

1. About these terms

BikeViewer ("BikeViewer", "we", "us") provides a browser-based 3D bicycle fit and geometry tool at bikeviewer.com and related subdomains (the "Service"). By creating an account, subscribing, or otherwise using the Service, you agree to these Terms of Use.

If you are using the Service on behalf of a business, a bike shop, fit studio, club or team, you confirm you have authority to bind that business, and "you" means that business.

2. Who can use BikeViewer

You must be at least 16 years old to create an account. If you are under 18, you may only use the Service with the involvement of a parent or guardian, and only they may enter payment details.

You may use the Service anywhere it is lawful to do so. You are responsible for complying with the laws that apply where you are.

3. Your account

You need an account to save work, sync between devices and subscribe. You agree to give accurate details, keep your password secure, and tell us promptly at denis@bikeviewer.com if you believe your account has been accessed without your permission.

You are responsible for activity under your account. Accounts are personal to you. Team plan seats are per person and must not be shared between fitters.

4. Plans, billing and cancellation

BikeViewer offers a free plan and paid plans (currently Pro, Max and Team). BikeViewer is currently in public preview. During the preview period, features listed against paid plans may be available on the free plan, and we may begin enforcing plan limits at any time with notice in the app. Nothing you have saved is deleted when limits begin to apply, though you may need a paid plan to add more. Prices are shown in Australian dollars and, unless stated otherwise, are inclusive of GST where GST applies. If you are outside Australia, Stripe may present and charge the equivalent amount in your local currency at checkout, using its own exchange rate. Your bank may apply its own fees on top.

• Renewal. Paid plans renew automatically until cancelled, monthly or annually depending on the plan you chose.
• Payments. Payments are processed by Stripe. We do not receive or store your full card details. Your use of Stripe's checkout is also subject to Stripe's own terms.
• Cancelling. You can cancel at any time from the billing portal linked in the app. Cancellation takes effect at the end of the current billing period; you keep paid features until then.
• Team plans. Team subscriptions are billed per seat with a three-seat minimum. Adding seats mid-period is charged pro rata; removing seats takes effect at the next renewal.
• Price changes. We may change prices, but not mid-period. We will give you at least 30 days' notice by email before a change affects your renewal, and you may cancel before it takes effect.

5. Refunds and consumer rights

If you are in Australia, our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms limits those rights.

Beyond those rights, we offer a practical refund policy: if you subscribe and find BikeViewer isn't for you, email us within 14 days of your first payment and we will refund it. We generally do not refund partial periods after that, but if something has gone wrong, tell us, we would rather sort it out than argue about it.

6. Your content

Rider measurements, bike setups, saved views, libraries, measurement notes and anything else you create in BikeViewer are yours. We claim no ownership of them.

You grant us a limited licence to store, process and display that content for the sole purpose of operating the Service for you, for example, syncing your views between your devices, or rendering a fit you have chosen to share by link. We do not sell your content, and we do not use it to train machine-learning models.

Share links. When you create a share link, the setup it describes is encoded in that link. Anyone who has the link can open it. Treat share links as public, and don't share fits containing details you would not want a stranger to see.

7. Acceptable use

Please don't:

• break the law, infringe anyone's rights, or use the Service to harass anyone;
• attempt to gain unauthorised access to our systems, other users' accounts or data;
• scrape, bulk-download or systematically extract the frame geometry database or other content, or use it to build a competing dataset or product;
• resell, sublicence or provide the Service to third parties as if it were your own, except by using a Team plan as intended;
• circumvent plan limits, or share one seat between multiple people;
• upload malicious code, or interfere with the Service's operation or availability.

We may suspend or terminate accounts that do these things, usually after warning you where it is reasonable to do so.

8. Fit and geometry data: important

Frame geometry in BikeViewer is drawn from published manufacturer charts and our own records. We work hard on accuracy, including checking figures against manufacturer sources and flagging where data is unverified, but we cannot guarantee that every value is correct, current, or that a manufacturer has not changed a frame mid-model-year.

Before you buy a frame or cut a steerer tube, verify the numbers against the manufacturer's own current geometry chart and, where possible, against the physical bike. Decisions you make using BikeViewer, including sizing, component selection and irreversible modifications, are yours, and you accept the risk of relying on modelled figures.

Derived values (trail, effective top tube, wheelbase, front-centre, standover, tyre pressure recommendations and similar) are calculated from the inputs you provide. Small differences from a manufacturer's published figures are normal, usually because brands round the angles they publish. Tyre pressure suggestions are a starting point only, always stay within the pressure ranges marked on your tyre and rim.

9. Exports and client work

BikeViewer can export your work as PDF fit reports, DXF drawings and CSV data. Those exports are yours to use, including commercially, and including for clients if you are a fitter or a shop.

If you upload a logo for branded reports, you confirm you have the right to use it, and you allow us to reproduce it in the reports you generate. We do not use it for anything else.

If you record client details in BikeViewer, you are responsible for having a lawful basis to hold them and for telling those people how their information is used. As between you and us, that information is your content under clause 6.

10. Intellectual property

The Service, including its software, 3D models, interface design, text, the BikeViewer name and logo, and the structure and curation of our geometry database, is owned by BikeViewer and protected by copyright and other laws.

We grant you a personal, non-exclusive, non-transferable right to use the Service in accordance with these terms and your plan. That right ends when your account or subscription ends.

You may export, screenshot and use images of your own fits, including commercially, on a paid plan, in your own bike-fitting or retail business. You may not remove or obscure BikeViewer attribution where it appears.

11. Third-party brands and data

Bicycle brand names, model names and trade marks referred to in BikeViewer belong to their respective owners. We use them descriptively, to identify the frames the tool can model. BikeViewer is not affiliated with, endorsed by, or sponsored by any bicycle manufacturer.

If you are a manufacturer and would like a correction to your frame data, or would prefer we remove it, email denis@bikeviewer.com and we will act promptly.

12. Availability and changes

We aim to keep BikeViewer available and working, but we don't promise uninterrupted service. We may need to interrupt it for maintenance, and things occasionally break.

The Service evolves. We add features, change them, and sometimes remove them. Where a change materially reduces what a paid plan offers, we will tell you in advance and you may cancel. Features marked preview, beta or early access may change or be withdrawn without notice.

13. Liability

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law or other law that cannot lawfully be excluded.

Subject to that:

• the Service is provided "as is" and we exclude all other warranties to the extent the law allows;
• we are not liable for indirect or consequential loss, loss of profits, loss of data, or the cost of equipment purchased in reliance on modelled figures;
• where our liability can be limited, it is limited (at our option) to resupplying the Service or paying the cost of resupply;
• in any case, our total liability to you in any 12-month period will not exceed the amount you paid us for the Service in that period.

14. Ending your use

You may stop using BikeViewer and delete your account at any time. On deletion, we remove your account data as described in our Privacy Policy.

We may suspend or end your access if you materially breach these terms, if required by law, or if we discontinue the Service. If we discontinue the Service entirely, we will give reasonable notice and refund any unused portion of a prepaid subscription.

15. Changes to these terms

We may update these terms. If a change is material, we will notify you by email or in the app before it takes effect. Continuing to use the Service after that means you accept the updated terms. The version in force is always the one published here, with the date at the top.

16. Governing law

These terms are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of New South Wales and the courts able to hear appeals from them.
